Terms And Conditions

Agreement Scope

These Terms & Conditions (“Agreement”) govern all services provided by Zephyr Customz (“Company”) to the customer (“Customer”). By booking, scheduling, or receiving services, the Customer agrees to be bound by this Agreement.

Services may include, but are not limited to:

  • Exterior and interior detailing

  • Paint correction and protection

  • Vehicle wraps, decals, and custom graphics

  • Additional or custom services as agreed

All services are performed based on the condition of the vehicle at the time of inspection. The Company reserves the right to adjust service recommendations and pricing accordingly.

Labor Charges

Labor charges are determined based on:
 

  • Vehicle size, type, and condition

  • Scope and complexity of the service

  • Time required to complete the work

  • All estimates are subject to change upon in-person inspection. Additional charges may apply if:

  • The vehicle condition differs from the initial description

  • Additional services are requested

  • The Customer will be notified and must approve any additional charges before work continues.

Insurance Claims

If the Customer believes that damage has occurred as a direct result of services performed by the Company, the following procedures and conditions apply:

  • The Customer must notify Zephyr Customz within 24 hours of service completion. Failure to report within this timeframe may result in denial of the claim.

  • The Customer must provide clear and verifiable evidence, including time-stamped photos and a written description of the alleged damage.

  • The vehicle must remain in substantially the same condition as it was immediately after service completion until the Company has had a reasonable opportunity to inspect it.

Upon receiving a claim:

  • The Company will conduct an internal inspection and assessment of the vehicle.

  • The Company reserves the right to request an in-person inspection before taking further action.

  • If the claim appears valid, it may be submitted to the Company’s insurance provider for further review.

The Company is not responsible for:

  • Pre-existing damage, including but not limited to scratches, dents, paint defects, oxidation, or interior wear

  • Damage resulting from improperly installed, loose, or worn parts

  • Electrical or mechanical failures not directly caused by the Company’s services

  • Damage that becomes visible only after cleaning, correction, or detailing processes

The Customer acknowledges that detailing and cleaning processes may reveal hidden or previously unnoticed defects, for which the Company is not liable.

All approved claims are subject to:

  • The terms, conditions, and limitations of the Company’s insurance policy

  • The final determination of the insurance provider

The Company’s liability, if any, shall be limited to the cost of the service performed or the cost of repair, whichever is less, unless otherwise required by law.

Storage Fees 

The Customer agrees to retrieve the vehicle within the agreed-upon timeframe following completion of services.

  • The Company may provide a 24-hour grace period after notifying the Customer that the vehicle is ready for pickup.

  • After the grace period, a daily storage fee may be charged until the vehicle is collected.

If the vehicle is not retrieved within a reasonable period:

  • The Company reserves the right to continue accruing storage fees

  • The Company may take action in accordance with applicable New Jersey law regarding abandoned vehicles, including but not limited to towing or transfer to a storage facility at the Customer’s expense

The Company shall not be responsible for:

  • Loss or damage occurring after the vehicle is left beyond the agreed pickup period

  • Vehicles left on the premises without prior approval

The Company also reserves the right to retain possession of the vehicle until all outstanding balances, including storage fees, are paid in full, as permitted by law.

Force Majeure

Zephyr Customz shall not be liable for any delay, interruption, reduced quality conditions, or failure to perform services resulting from events or circumstances beyond its reasonable control (“Force Majeure Event”).

Force Majeure Events include, but are not limited to:

  • Severe or unsafe weather conditions, including rain, snow, hail, extreme heat or cold, high winds, or flooding

  • Natural disasters, including hurricanes, earthquakes, or other acts of nature

  • Fire, explosion, or damage to facilities, equipment, or vehicles

  • Power outages, water shortages, or utility failures

  • Government actions, laws, regulations, restrictions, emergency orders, or shutdowns

  • Labor disputes, shortages, illness, or unavailability of staff

  • Supply chain disruptions, material shortages, or delays in obtaining necessary products or equipment

  • Transportation delays, road closures, or accidents

  • Acts of terrorism, civil unrest, or public disturbances

  • Any other event or condition outside the Company’s reasonable control

In the event of a Force Majeure Event:

  • The Company may delay, reschedule, modify, or cancel services without liability

  • The Company will make reasonable efforts to notify the Customer of any changes as soon as practicable

  • Service timelines are estimates only and are not guaranteed under such conditions

The Customer acknowledges and agrees that:

  • Many detailing, wrapping, and exterior services are environment-sensitive and may be affected by weather, temperature, humidity, or contamination conditions

  • The Company reserves the right to postpone or halt services if conditions are deemed unsuitable to achieve proper results or maintain safety standards

  • Any such decision shall be made at the sole discretion of the Company

The Company shall not be responsible for:

  • Any loss, damage, delay, or inconvenience caused directly or indirectly by a Force Majeure Event

  • Any costs incurred by the Customer as a result of rescheduling or service interruption

If a Force Majeure Event continues for an extended period:

  • The Company reserves the right to terminate or suspend the affected service without liability

  • Any payments made may be applied to rescheduled services or handled at the Company’s discretion, subject to applicable law

Nothing in this section shall require the Company to perform services under conditions that are unsafe, impractical, or likely to compromise the quality of the work.

Privacy Policy

Zephyr Customz is committed to protecting Customer privacy and handling personal information in a responsible and transparent manner.

Information Collected

The Company may collect and maintain the following types of information:

  • Personal identification information, including name, phone number, email address, and billing address

  • Vehicle information, including make, model, year, condition, license plate number, and service history

  • Payment and transaction information, including invoices, receipts, and payment method details (processed through third-party providers)

  • Communication records, including emails, text messages, call logs, and service-related correspondence

  • Website usage data, if applicable, including IP address, browser type, device information, and general usage behavior

How Information Is Used

Collected information is used strictly for legitimate business purposes, including:

  • Scheduling, confirming, and completing services

  • Communicating with Customers بشأن appointments, updates, delays, or issues

  • Processing payments and maintaining financial records

  • Providing customer support and resolving disputes

  • Improving services, operations, and customer experience

  • Complying with legal and regulatory requirements

Information Sharing and Disclosure

The Company does not sell or rent Customer information. Information may only be shared in the following circumstances:

  • With third-party service providers (such as payment processors or scheduling platforms) strictly for business operations

  • With insurance providers when processing or investigating claims

  • When required by law, court order, or legal process

  • To protect the rights, property, or safety of the Company, its employees, or others

All third parties are expected to handle Customer information in accordance with applicable privacy standards.

Data Storage and Security

The Company implements reasonable administrative, technical, and physical safeguards to protect Customer information from unauthorized access, loss, misuse, or alteration.

However, the Customer acknowledges that:

  • No system can guarantee complete security

  • Electronic communications and data storage carry inherent risks

The Company is not liable for unauthorized access resulting from circumstances beyond its reasonable control.

Data Retention

Customer information will be retained only for as long as necessary to:

  • Fulfill the purposes outlined in this Agreement

  • Maintain business and financial records

  • Comply with legal, tax, and regulatory obligations

The Company reserves the right to retain records for a reasonable period even after services are completed.

Customer Rights

Customers may request to:

  • Access or review their personal information

  • Correct inaccurate or outdated information

  • Request deletion of personal data, where applicable

Such requests must be submitted in writing. The Company may retain certain information as required by law or for legitimate business purposes.

Cookies and Tracking (If Applicable)

If the Company operates a website, it may use cookies or similar technologies to:

  • Improve website functionality and performance

  • Analyze traffic and user behavior

  • Enhance user experience

Customers may adjust browser settings to refuse cookies, though some features may not function properly.

Third-Party Links

The Company’s website or communications may include links to third-party websites. The Company is not responsible for the privacy practices or content of those external sites.

Policy Updates

The Company reserves the right to update or modify this Privacy Policy at any time. Updates will become effective upon posting or communication to Customers.

Continued use of services after any changes constitutes acceptance of the updated policy.

Test Drives

The Customer authorizes Zephyr Customz and its employees to operate the vehicle as necessary to complete services.

This may include:

  • Moving the vehicle within or around the service location

  • Performing short test drives for quality control or verification purposes

All vehicle operation will be:

  • Limited in distance and duration

  • Conducted with reasonable care and in compliance with applicable laws

The Customer confirms that:

  • The vehicle is in safe operating condition

  • The vehicle is properly registered and insured

The Company is not responsible for:

  • Mechanical failures, breakdowns, or safety issues resulting from pre-existing conditions

  • Issues that arise due to the vehicle’s age, condition, or prior damage

If a test drive is deemed necessary and the vehicle is unsafe to operate, the Company reserves the right to decline operation and notify the Customer.

Communication

By providing contact information, the Customer consents to receiving communications from Zephyr Customz related to services.

These communications may include:

  • Appointment confirmations and reminders

  • Service updates and completion notifications

  • Estimates, invoices, and payment requests

  • Follow-ups regarding service quality

Communication may be conducted via:

  • Phone calls

  • Email

  • SMS or text messages

The Customer is responsible for:

  • Providing accurate and up-to-date contact information

  • Monitoring communications related to their service

The Customer may opt out of non-essential or marketing communications at any time. However, the Company may still send essential service-related communications necessary to fulfill its obligations.

The Company is not responsible for missed appointments or delays resulting from:

  • Incorrect contact information

  • Failure to review or respond to communications
